Campaign's General Terms and Conditions

  1. These terms and conditions (“Terms and Conditions”) shall govern all campaigns and all contests (each referred to as “Campaign”) organised or co-organised by BIGLIFE Sdn. Bhd. and/or any of its subsidiaries (“Organiser”) on the airasia Superapp application and the Organiser’s website at https://www.airasia.com/. (“Dedicated Platform”), and shall be a legally binding document between you and the Organiser in addition to those specific terms and conditions of each Campaign (“Specific T&C”). By participating or upon entry of the Campaign, all participants (“Participants”) agree to be bound by this Terms and Conditions, and shall be deemed to have given their consent for the collection of personal information and the use of such personal information shall be in accordance with the Privacy Policy of the Organiser which can be located at https://www.airasia.com/aa/rewards/en/gb/privacy-policy.html with no monetary payment.
  2. Information on how to participate in the Campaign forms part of its conditions of entry. Registration for and/or participation in the Campaign is deemed as acceptance of its conditions of entry. Acceptance of the Terms and Conditions is a condition of entry.
  3. The Participants who satisfy all the Campaign Requirements (as defined in the Specific T&C) shall be eligible to win the Campaign and/or receive the airasia points or any prize provided by the Organiser (“Prize”). The Participants who provide incomplete entries or fail to abide by the Campaign Mechanism will automatically be disqualified from the Campaign without any further notice and liability towards the Organiser.
  4. The Organiser reserves the right to disqualify any entry by the Participants which are deemed to contain offensive, inappropriate and/or obscene elements. Such entries will be disqualified immediately.
  5. The Organiser reserves the right in its sole discretion, at any time, to verify the validity of successful transactions and eligibility of the Participants. Without limitation, the Participants agree to provide necessary information to the Organiser upon request.
  6. The Organiser reserves the right in its sole discretion to substitute and/or replace the airasia points or the Prize from time to time without any prior notice to the Participants.
  7. airasia points are not reversible, exchangeable and cannot be exchanged or redeemed for cash. Usage of airasia points is subject to the airasia membership terms and conditions which can be found at www.airasia.com/rewards.
  8. The Participants may be contacted, at any time deemed appropriate by the Organiser, via email or any other mode of communication deemed appropriate by the Organiser.
  9. The Participants shall not hold the Organiser liable for the outcome of the Campaign.
  10. If for any reason the Campaign is unable to proceed or operate smoothly due to actions of the Participants, including but not limited to irregularity, tampering, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Campaign, the Organiser reserve the right in its sole discretion to cancel, terminate, modify, postpone or suspend the Campaign.
  11. The Organiser reserves the right in its sole discretion to disqualify any Participant and/or to retract or forfeit the airasia points or the Prize from any Participant if the Organiser have proof or reasonably believes that the Participant has (singularly or jointly with any other Participant) undertaken fraudulent practices and/or activities to obtain the airasia points or other activities harmful to the Campaign or to the Organiser. The Organiser further reserves the right to block the Participant’s airasia account from performing future transactions on the Dedicated Platform.
  12. The Organiser reserves the right in its sole discretion to cancel, terminate or suspend the Campaign with or without any prior notice and/or assigning any reason. For the avoidance of doubt, cancellation, termination or suspension by the Organiser shall not entitle the Participants to any claim or compensation against the Organiser for any and/or all losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
  13. The Organiser accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, corrupted or misdirected transaction(s) whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise.
  14. The Organiser, its subsidiaries, affiliates, and associated companies shall bear no responsibility for any damage, loss (including but not limited to direct, indirect, special and consequential loss or loss of profits), expense, liability, disappointment, personal injury, or death which is incurred, suffered or sustained (whether or not arising from any person’s negligence) by the Participants in connection with the Campaign, the promotion of the Campaign or the use of any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  15. The Participants agree to hold harmless, defend and fully indemnify the Organiser from and against all losses (including loss of opportunity and consequential loss arising therewith), damages, expenses and all third party actions, proceedings, claims, demands, costs (including without prejudice to the generality of this provision, the legal cost of each other, personal injuries, death, loss or destruction of property, rights of publicity or privacy, defamation), awards and damages that may arise as a result of the Campaign.
  16. The Terms and Conditions contained herein and the respective campaign shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the Campaign.
  17. The Organiser reserves the right in its sole discretion to vary, delete or add to any of the terms and conditions contained herein, without any prior notice to the Participants. Such revised Terms and Conditions will be posted on the Oganiser’s website at https://www.airasia.com/ and immediately become effective when posting them. The decision of the Organiser in relation to every aspect of the Campaign including but not limited to the airasia points awarded to the Participants shall be deemed final and conclusive under any circumstances and no correspondence, appeal nor complaint from any Participants will be entertained.
  18. The Organiser shall not be liable for any failure to comply or for any delay in performing its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not limited to, weather conditions, fire, flood, hurricane, computer system malfunction, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, epidemic and pandemic as pronounced by the World Health Organisation, inevitable accidents, supervening legislation or any other circumstances of whatsoever nature beyond the control of the Organiser.
  19. All expenses associated with the Campaign such as transportation, accommodation or any other costs of a personal nature that are not stated (if applicable) shall be solely borne by the Participants.
  20. All taxes, rates, government fees or any other charges that may be levied against the Participants under applicable laws, if any, in relation to the Campaign, shall be solely borne by the Participants.
  21. The Terms and Conditions may be translated to other languages. In the event of any inconsistency between the English and translated versions, the English language shall prevail.
  22. These Terms and Conditions are governed by the laws of Malaysia and subjected to the jurisdiction of a forum in Malaysia.
  23. In the event of any conflict or inconsistency between this Terms and Conditions and any terms and conditions set forth in the Specific T&C, the Specific T&C shall prevail.
