AirAsia money Terms and Conditions (Malaysia)

Introduction

  1. These terms and conditions (“Terms and Conditions”) shall govern your activity on https://www.airasia.com/money/en/gb (“AirAsia Money”) which is available on the AirAsia MOVE mobile application and airasia.com website (collectively referred to as the “Platform”) and shall be the legally binding document between you and AirAsia Com Travel Sdn. Bhd. (“AirAsia, us, we, our”).
  2. AirAsia Money allows you to purchase, create or apply for various financial products and services (“Products and Services”) by way of redirecting you to the relevant platforms (“Partner’s Website”) operated by fintech companies and/or financial institutions that we have partnered with (“Partners”). Further, you agree and acknowledge that the fulfillment of the Products and Services available on AirAsia Money are also performed by our Partners.
  3. You accept and acknowledge that we are only the owner and operator of the Platform and not a distributor of the Products and Services and therefore, assume no liability should there be any loss or damages as a result of any act or omission or negligence on the part of the Partners in the course of their performance. Further, you acknowledge and accept that you will be subjected to the respective terms and conditions of the Partners which is available on the Partner’s Website and agree to be bound by such terms and conditions.
  4. By choosing to transact on any of the Products and Services through AirAsia Money you are deemed to have read, understood, accepted and agreed to be bound by these Terms and Conditions, as well as the Privacy Statement and Terms of Use of the Platform which may be amended and revised from time to time. In addition to these Terms and Conditions, you shall also be bound to the terms and conditions of the respective Partners, and any additional terms and conditions stipulated herein which may also be amended and revised from time to time.

Transaction Policy (Malaysia)

  1. You must have the legal capacity to be bound by these Terms and Conditions and that you are at least eighteen (18) years old.
  2. You shall access the Platform, and click on the ‘airasia money’ tile.
  3. You have the option to choose the types of Products and Services that you wish to purchase, create or apply on.
  4. After selecting the types of Products and Services, you will be automatically redirected to the Partner’s Website. You will then be required to register your valid email address on the Partner’s Website. For the purpose of clarity, the Partner’s Website is accessible through AirAsia Money.
  5. We advise you to review and fully comprehend the terms and conditions of the relevant Products and Services available on the respective Partner’s Website. Further, you agree and acknowledge that the respective Partner has the right to accept, or refuse any request for purchase, creation or application for Products and Services available in the Partner’s Website in accordance with the conditions as stipulated on the respective Partner’s Website.
  6. By clicking “Purchase”, you are deemed to have understood that the payment method to purchase the Products and Services shall only be by way of online banking, credit card and any other payment method available in the Partners.
  7. After you have successfully made a purchase, creation or application for Products and Services, you will receive a confirmation in your registered email address from the relevant Partners.
  8. Should you discover that there are issues with your purchase, creation, or application of the Products and Services and/or your activity on AirAsia Money, please contact our customer support immediately through the Platform.

Cancellation Policy (Malaysia)

  1. AirAsia and the Partners reserve its absolute right to cancel, terminate or suspend any purchase, creation or application for Products and Services with or without any prior notice and/or assigning any reason hereto. For the avoidance of doubt, cancellation, termination or suspension by us shall not entitle you to any claim or compensation against us for any and/or all losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
  2. Any cancellation or refund requests of the Products and Services shall be communicated through our customer support available in the Platform. For the purposes of clarity, the cancellation or refund will be processed and completed by the respective Partners in accordance with their respective terms and conditions

Miscellaneous (Malaysia)

  1. We reserve the right to use any collected personal data in accordance with AirAsia and the Partner’s privacy statement. By making a purchase, creation or application for Products and Services through AirAsia Money, you are deemed to have consented to such use with no monetary payment whatsoever.
  2. You may be contacted with respect to any matter in regards to your purchase, creation or application for Products and Services AirAsia Money under AirAsia at any time deemed appropriate by us in your registered email or any other mode of communication deemed appropriate by us.
  3. These terms and conditions contained herein shall prevail over any inconsistent terms, conditions, provisions or representations contained in any advertising materials for any purchase, creation or application for Products and Services through AirAsia Money. In the event of any inconsistency between the English version and any translation thereof, the English version of the terms and conditions shall prevail and supersede.
  4. We reserve the absolute right to vary, delete, update or add to any of these terms and conditions (wholly or in part) from time to time without any prior notice. Our decision in relation to all aspects of purchase, creation or application for Products and Services AirAsia Money is deemed final, binding and conclusive under all circumstances and no correspondence, complaint or appeal whatsoever will be entertained
  5. AirAsia, the Partners, subsidiaries, affiliates, and associated companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the purchase, creation or application for Products and Services through AirAsia Money.
  6. AirAsia and the Partner(s) shall not be held liable for any claim, damages, loss, which the passenger may incur from any of your purchase, creation or application for Products and Services through AirAsia Money.
  7. You agree to defend and indemnify us and any of our officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of your breach of these Terms and Conditions, your violation of any law or the rights of a third party or your use of our information.
  8. In addition to the Terms and Conditions contained herein, you also acknowledge and accept that upon your purchase, creation or application for Products and Services through AirAsia Money, you will be further subjected to the respective Partner’s terms and conditions that can be found on the relevant Partner’s Website.
  9. In the event of any inconsistency between these terms and conditions and the respective Partner’s terms and conditions, these terms and conditions shall prevail with only to the extent of such inconsistency.
  10. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Malaysia.
